WHAT THIS SERVICE IS

Trademark Registration — Protect What You've Built

Your brand name, logo, and identity are often the most valuable assets your business owns — yet most Pakistani businesses leave them completely unprotected. Without trademark registration, anyone can copy your name, file it before you, and legally force you to rebrand. As a trademark lawyer in Lahore and High Court Advocate, Advocate Inam Ur Rehman handles every step of your IPO Pakistan trademark registration — from search to certificate.

Your filing date is what protects you — not the certificate date. The moment your application is filed with IPO Pakistan, you have priority over anyone who files the same mark after you. This is why filing early matters more than anything else in trademark law.

Your Filing Date Is Your Protection Date

Filing date = protection date. From the moment your TM-1 is filed with IPO Pakistan, you have legal priority over anyone who files the same or similar mark after you — even though the certificate takes 12–24 months to arrive. File as early as possible. The certificate is confirmation of protection that already started on filing day.

WHY YOU MUST REGISTER

What Registration Gives You

THE MOST IMPORTANT DECISION

Class Selection — The Foundation of Your Protection

Pakistan uses the Nice Classification system — 45 international classes dividing all goods (Classes 1–34) and services (Classes 35–45). Your trademark is only protected within the class(es) you register in. Filing in the wrong class means your brand is unprotected in your actual business. Filing in too few classes leaves competitors free to register your name for adjacent activities.

Why Class Selection Is Critical

Your enforcement power is bounded by your registered classes. If a competitor uses your brand name in a class where you are not registered, your only legal recourse is a 'passing off' action — which requires proving goodwill, misrepresentation, and damage at a significantly higher evidentiary burden. Class selection is not an administrative detail. It is the most important decision in your trademark filing.

Here are the most commonly registered classes for Pakistani businesses:

Class Covers Typical Businesses
Class 3 Cosmetics, beauty, personal care products Skincare brands, salons, hair care
Class 5 Pharmaceuticals, medical preparations Medicine brands, health supplements
Class 9 Electronics, software, apps, technology Tech companies, apps, digital products
Class 16 Paper goods, printed materials, stationery Publishers, print media, stationery
Class 25 Clothing, footwear, headwear Fashion brands, garment businesses
Class 29 Meat, dairy, processed foods Food businesses, packaged goods
Class 30 Tea, coffee, bakery, confectionery Restaurants, tea brands, food products
Class 35 Advertising, business services, retail Agencies, consultancies, trading companies
Class 36 Financial, insurance, real estate services Banks, fintech companies, property agents
Class 41 Education, training, entertainment Schools, academies, media companies
Class 42 IT services, software development, research and development Software houses, IT firms, SaaS companies
Class 43 Restaurants, hotels, catering Restaurants, cafes, food delivery businesses
Class 45 Legal services, personal services Law firms, consultancies

As your trademark lawyer in Lahore, we analyse your business, current products, future expansion plans, and competitor landscape before recommending which class(es) to file in. A wrong class can waste months and thousands of rupees in rejected applications.

OUR PROCESS

Step-by-Step — From Search to Certificate

1

Trademark Search (TM-55)

Before filing anything, we search the IPO Pakistan register for identical and confusingly similar marks. A pre-filing search prevents the most common and costly mistake: filing a mark that will be rejected or opposed because a similar mark already exists.

2

Risk Assessment & Class Selection

We review the search results, assess the risk level, recommend the right class(es), and advise on any modifications to the mark that improve registrability. You make an informed decision before spending on government fees.

3

Application Prepared & Filed (TM-1)

We prepare the TM-1 form with the exact goods/services specification, logo representation, and Power of Attorney (Form TM-48 on stamp paper). Filed at IPO Pakistan Lahore within 3-5 days of your document approval.

4

IPO Examination

IPO examines your application — typically within 3-9 months. If any objections are raised (similarity, descriptiveness, incorrect class), we draft and file the legal reply. You can use from this point forward.

5

Trademarks Journal Publication

Once accepted, IPO publishes your mark in the Trademarks Journal for a 2-month opposition window. Any third party can oppose within this period. We monitor the journal and handle any opposition that arises.

6

Registration Certificate (TM-11)

If no opposition (or opposition resolved), we file Form TM-11 and IPO issues your Trademark Registration Certificate. Valid for 10 years from your original filing date. You can now use ®.

IMPORTANT DISTINCTION

™ vs ® — Know the Difference

Topic Details
™ (Trademark Symbol) Can be used immediately on filing your TM-1 application. Signals a claim of trademark rights. Not a registered mark — anyone can use ™ on any mark they claim.
® (Registered Trademark) Can only be used after IPO Pakistan issues the Registration Certificate. Using ® before registration is a criminal offence under the Trademarks Ordinance. Do not use ® until you hold the certificate.
When You're Protected From your filing date — not from when you receive the certificate. The certificate confirms and backdates protection to the day of filing.
Renewal Every 10 years from the filing date. A six-month grace period applies for late renewal. Letting a trademark lapse removes all protection — competitors can then register your name.

FAQS

Frequently Asked Questions

The application is filed with IPO Pakistan within 3-5 days of receiving your documents. The full process — from filing to certificate — typically takes 12 to 24 months due to IPO's examination and journal publication timelines. This is IPO's processing time, not ours. Your brand is protected from the filing date — the certificate simply confirms that protection after the fact.

Ideally yes — both are separate trademarks. A word mark protects your brand name in any font or style. A logo/device mark protects your specific visual design. Registering both gives you comprehensive protection. If budget is a concern, most trademark lawyers recommend starting with the word mark — as it provides the broadest protection across all representations of the name.

They may have common-law rights based on prior use (called 'passing off' protection in Pakistan) — but this is weak, geographically limited, and expensive to enforce. If you register the mark first, you gain superior statutory rights. However, if they have been using the mark extensively before your filing and can prove prior goodwill, they may oppose your registration. This is why a pre-filing search and early filing are critical. Send us your brand name on WhatsApp and we'll assess the risk.

IPO may raise examination objections — for similarity to existing marks, descriptiveness, or incorrect classification. These are not final rejections. We respond with a written legal reply providing arguments and evidence. Most objections are resolved at this stage. If IPO still refuses, there is an appeal mechanism before the Registrar and then the High Court. A well-prepared initial application with proper class selection significantly reduces the chance of objections.

Yes — during the 2-month opposition window after Trademarks Journal publication, any third party can file Form TM-5 to oppose your registration. Common grounds for opposition include similarity to an existing mark and bad faith. If opposed, we represent you in the opposition proceedings. Most oppositions are resolved through negotiation (co-existence agreements) before a full hearing.

Yes — especially if you are building a brand clients will remember. Trademark protection is not just for large corporations. A freelancer's brand, a small restaurant's name, a clothing label's logo — these are all worth protecting. Once registered, no one can legally copy your brand identity, and you have the legal tools to stop them if they try. The cost of registration is a fraction of the cost of rebranding after someone steals your name.

Pakistan is a member of the Madrid Protocol — an international trademark system administered by WIPO. Once you have a Pakistani trademark application or registration, you can file a single international application to extend protection to 130+ countries including UAE, UK, USA, Saudi Arabia, China, and the EU. This is significantly cheaper and faster than filing separately in each country. IUR advises on international filing strategy for clients expanding globally.
