What Happens When Your Copyright Is Infringed
Copyright infringement in Pakistan is both a civil wrong and a criminal offence under the Copyright Ordinance 1962 as amended:
- Civil remedy — file a civil suit for damages, account of profits, and injunction to stop the infringer.
- Criminal prosecution — lodge a complaint with the Federal Investigation Agency (FIA) for criminal infringement. Penalties include imprisonment of up to 3 years and fines up to Rs. 150,000.
- Copyright Amendment Bill 2024 proposes raising maximum fines to Rs. 1 million — a substantially stronger deterrent.
- Customs Act 1969 — enables border seizure of infringing imported goods bearing your copyrighted work.
- Injunction — courts can issue urgent orders to stop infringers immediately upon receipt of your registration certificate.
